America's Freedoms Rely on the Separation of Powers Between the Branches of Government. Ginni Thomas' newly released text messages call that Separation into Question.

Virginia "Ginni" Thomas and Clarence Thomas

The House January 6th Committee has recently begun an investigation into Virginia “Ginni” Thomas’ actions surrounding the Capitol riots on January 6th. The investigation began after text messages between Ginni Thomas, wife of Supreme Court Justice Clarence Thomas, and former Trump Chief of Staff, Mark Meadows, became public.

Ginni Thomas wrote Meadows pressuring him to overturn the 2020 presidential election results.

The House select committee announced plans for her to appear in late March. America’s democracy, and the freedoms its citizens enjoy, have been protected for over 250 years largely due to a system that prevents conflicts of interest from arising between the branches of government. Because each branch is intended to be a counter balance to the powers of the other branches, conflicts of interest between branches can severely jeopardize democracy.

With these newly public conversations between Ginni and Mark Meadows, serious questions about the independence of Supreme Court Justice Clarence Thomas have surfaced, leaving Supreme Court Justice Clarence Thomas in hot water.

Clarence Thomas’ past rulings and votes are now under increased scrutiny given his wife’s comments and text messages to the White House. Clarence Thomas was the only member of the Supreme Court to vote for a request by former President Donald Trump to block the release of presidential records that the committee is seeking. Those records could highlight more interactions between Clarence Thomas’ wife and the White House as the January 6th riots were taking place.

There were three election-related cases where Clarence Thomas voted in a manner that seems consistent with his wife’s activism. With these newly released text messages, his ability to remain impartial in these proceedings is in question. Federal law mandates “disqualification from any proceeding in which his impartiality may be questioned.”

Ginni Thomas has multiple know affiliations with right-wing groups along with progressive public officials, including Cleta Mitchell, who was on the call in which former President Trump made to Georgia’s secretary of state, Brad Raffensperger, where he was encouraged to“find” enough votes to swing the state’s electors in favor of Donald J. Trump.
